Abstract |
Background. The institution of insolvency (bankruptcy) is currently very relevant and essential for both legal entities and individuals. Rapid development in the economic and political spheres cannot but affect the formation and evolution of rules on insolvency. According to many researchers, the shortcomings in legal regulation of the institution of bankruptcy will certainly lead to adverse consequences in the economic sphere. The relevance of the research topic lies in identifying both theoretical and practical problems of legal regulation in the field of insolvency (bankruptcy). The modern institution of bankruptcy is based on problems and complications that civil researchers studied and elaborated in ancient times. Under the influence of rapid development of the country’s economy, these relations were constantly supplemented and sophisticated in accordance with modern realities. However, many problems studied by pre-revolutionary lawyers still remain relevant. Therefore, the study of the historical and theoretical features of the institution of insolvency is directly dependent on the political and economic transformations in the country. The work aims at studying and analyzing the historical stages of the formation and development of the institution of insolvency (bankruptcy), determining the influence of history on modern relations of subjects in the bankruptcy procedure, identifying the main unresolved problems in legal regulation of the institution of insolvency (bankruptcy) and proposing solutions to the identified problems. Materials and methods. The objectives of the work are achieved through historical and theoretical analysis of the legal norms governing the features of the insolvency (bankruptcy) procedure in various historical periods: from ancient times to the present days. The methods of analysis and synthesis used in the work enable determining the degree of influence of historical experience on the current state of the institution of insolvency (bankruptcy), and also make it possible to develop basic proposals for improving the current legislation, taking into account not only the historical approach, but also the analysis of judicial practice of various periods. Results. The author studies the historical and theoretical aspects in legal regulation of the formation and subsequent development of the institution of insolvency (bankruptcy). The main problems that arise for the subjects in the exercise of their rights at certain stages of the bankruptcy procedure, as well as their impact on the subsequent development of legal norms, are identified. Conclusions. An analysis of the historical and legal development of the institution of bankruptcy allows asserting that pre-revolutionary Russian law provided answers to a large number of questions in the field of insolvency. The constant improvement of legislative frameworks in the field of bankruptcy has a significant impact not only on the formation and development of this institution, but also on the economic and political processes in the country. |
